Qualcomm Now Trying To Have iPhone XS, XR Banned In China As Well

Apple will update iPhones in China with new software next week that the company says will address the contentious features Qualcomm claims infringe its patents.

"Apple will be forced to settle with the Respondent, causing all mobile phone manufacturers to relapse into the previous unreasonable charging mode and pay high licensing fees, resulting in unrecoverable losses in the downstream market of mobile phones", the iPhone maker said in the December 10 filing to the court.

Responding to a recent Chinese court order instructing Apple to stop sales of its iPhones in China, Apple said it will release an operating system update next week to avoid potential compliance issues in an ongoing patent dispute, according to a statement on Friday from the Cupertino, California-based company. Qualcomm has requested that the Chinese courts explicitly include the iPhone XS, iPhone XS Max, and iPhone XR in the injunction, counter to Apple's initial comments that the technologies in question wouldn't affect those models. The report further explains Apple would roll out software updates to its ban imposed iPhones in an attempt to fix possible issues.

Apple hit by China iPhone sales ban - but will it be enforced? Jiang Hongyi, the lawyer representing Qualcomm in the patent suits, told the Financial Times: "We plan to use the same patents to file suit against the 3 new iPhone models".

The case against Apple is basically a part of a global patent dispute between the two tech giants which comprises of several lawsuits.

The US company said it was taking that step to ensure it complies fully with the ruling, which resulted in sales injunctions against six older versions of Apple's most important device.

Apple has asked a Chinese court to reconsider the ban. If this comes to pass, it would be an enormous win for Qualcomm in its years-long fight with Apple over alleged patent licensing infringement. "Apple, many other companies, and consumers ... will suffer truly irreparable harm, [and the Chinese government] may suffer hundreds of thousands of tax losses".
