James Comey and Loretta Lynch subpoenaed to testify in twilight of House Republican power

James Comey, the former head of the Federal Bureau of Investigation who was sacked by President Trump, says he will push back on a subpoena to appear in a closed-door session before the House Judiciary Committee unless he is allowed to testify publicly.

Comey, who was sacked by Trump, tweeted of House Republicans: "I've seen enough of their selective leaking and distortion". House Republicans have been probing the FBI's actions leading up to the 2016 presidential election. Neither document stated the reason for subpoenas, but United States media said House Republicans have been probing the Justice Department's actions in the past years over suspected bias against Donald Trump.

The orders direct Comey to appear on December 3, while Lynch is to appear on December 4, to speak with members of the House Judiciary, and Oversight and Government Reform Committees. CBS News' Rebecca Kaplan has previously reported that Democrats plan to demand the hearings with Comey and Lynch be held publicly.

The subpoenas come three weeks before the House Judiciary Committee switches hands.

Subpoenas issued on Wednesday show the two will be asked to "testify at a deposition touching matters of inquiry committed to said committee".

Comey's lawyer David Kelley reacted to the subpoena and wasn't as vague as his client was, in terms of what "resist" means. "Let's have a hearing and invite everyone to see", he tweeted.

Mr Comey confirmed he had received a subpoena from the House Judiciary Committee but said he would resist if made to answer questions behind closed doors. Republicans allege that the former FBI Director leaked memos of these meetings to the New York Times via a friend, a maneuver that led to the appointment of Special Counsel Robert Mueller and the opening of the ongoing "Russiagate" investigation.

"Months ago, Director Comey and Attorney General Lynch both indicated their willingness to answer the Chairman's questions voluntarily", Nadler wrote.
