It is further stated that Alok Verma had received a complaint on October 5 regarding corruption allegations against top functionaries in the Rafale deal. The court has also ordered CBI to "maintain status quo" with regards to this issue, with Justice Najmi Waziri stating that the "petitioner is before court now".

"The defacto removal of Verma was in gross violation of laws and procedures".

Verma, who took charge as CBI director in February previous year, was due to demit office in February 2019, and a lot of questions have been raised about the Modi government's decision to remove him in the middle of his tenure.

As per reports, Rao was praised for his investigation into coal smuggling cases in Talcher.

The CBI on Thursday said Alok Verma, who has been divested of his powers, will remain its Director and the agency's number two Rakesh Asthana will continue as the Special Director, while M Nageshwar Rao has been given interim charge of the agency.

His reporting officer Additional SP SS Gurm was transferred to Jabalpur while supervisor DIG MK Sinha was moved to Nagpur, the order said. The court also ruled that the CBI director could be transferred only under extraordinary circumstances and the transfer needs to be approved by the Selection Committee, none of which have been done. Those named in the case are Bhaben Maitra, Abinash Kumar Sarkar, Subhashree Das, Jayaram Garada, Bipra Charana Maharana, Jisudan Khosla, Urdhab Khola and Sadananda Nayak and some "unknown officials".

Jaitley said on Wednesday that the government's decision to remove the CBI's two top officers was based on the Central Vigilance Commission's (CVC) recommendations.

The case will be heard in the Supreme Court next on 26 October.
