The White House counsel, Don McGahn, may leave the Trump administration in short order after cooperating extensively with the special counsel's investigation into possible criminal wrongdoing from President Donald Trump. Emmet Flood, who joined Trump's White House in May as in-house counsel for the Mueller probe, has been considered a leading candidate to replace McGahn and has the departing attorney's support, two administration officials said. McGahn had chose to stay on to lead the confirmation process of Kavanaugh, according to sources.

However, there is no guarantee Brett Kavanaugh will be confirmed to the Supreme Court, throwing the timing of McGahn's departure into question.

McGahn has served an important role in the Trump administration due to his leadership on the nomination and confirmation of federal judges, including Supreme Court Justice Neil Gorsuch's confirmation. Before taking the White House post, he was working as a partner at the Jones Day law firm in Washington on issues of political law.

The New York Times reported earlier in August that McGahn had given 30 hours of interviews to Mueller over the past nine months. Flynn was forced to resign after reports revealed Yates' warning to McGahn about Flynn's conduct. His reaction was, "Of course it happened this way", one person said. Sessions eventually did recuse himself, giving his deputy, Rod Rosenstein, the ultimate authority to appoint a special counsel.

The development comes as legal risks to the President rise, following the conviction of his former campaign chairman Paul Manafort last week on fraud charges and his former personal lawyer Michael Cohen's guilty plea to charges of fraud and campaign finance violations.
