OK, the Supreme Court said, in terms of affirmative action, that there are two interests that justify the use of race, one, to remedy the present effects of past discrimination, and, two, to achieve diversity in education, particularly higher education.

While the decision does not change current United States law on affirmative action, it provides a strong illustration of the administration's position on an issue that could take on renewed attention with the departure of Justice Anthony Kennedy from the Supreme Court.

"Last year, the Attorney General initiated a review of guidance documents, which resulted in dozens of examples - including today's second tranche of rescissions - of documents that go beyond or are inconsistent with the Constitution and federal law", spokesman Devin O'Malley told the network. However, the action does suggest that the federal government will be more willing to investigate complaints by applicants that they were denied entrance to a particular college due to their race, experts said.

"The Supreme Court has determined what affirmative action policies are Constitutional, and the Court's written decisions are the best guide for navigating this complex issue", DeVos said in a statement.

The Obama guidelines were a departure from previous recommendations from the administration of Republican President George W. Bush, who encouraged race neutral admissions policies.

The studies were filed in Boston's federal court as both sides attempted to persuade a judge to end the suit before it reaches trial, which has been scheduled to start in October.

The Education Department's action forecasts how much is at stake in the upcoming Supreme Court nomination process.
