Sharkie's future in doubt after latest High Court ruling

Dual citizens are ineligible for election to federal parliament under Australia's 117-year-old constitution and the decision is likely to render three other lawmakers in similar predicaments ineligible as well.

There will be two by-elections in Western Australia.

The four lower house MPs facing byelections are Mr Wilson and Labor's Susan Lamb and Justine Keay, as well as Rebekha Sharkie of the Centre Alliance, formerly the Nick Xenophon Team.

Senator Katy Gallagher has been found ineligible to sit in Parliament, the High Court unanimously ruled this morning.

Five Australian parliamentarians were ousted on Wednesday for holding dual citizenship when they were elected.

"Every opportunity I am given to ask the people of Fremantle to trust me with the responsibility of being their representative in the national parliament is an opportunity I will relish", he said.

Gallagher had argued that although she was a dual national when elected in 2016, she had taken all reasonable steps to renounce the British citizenship she inherited from her father.

The Labor backbencher gave an emotional speech a year ago defending her dual citizenship, which she said could not renounce because she was estranged from her mother who held the documents needed.

She added that Barnaby Joyce remained in the role of Deputy Prime Minister for some time as a known dual citizen who had taken no steps to renounce his New Zealand citizenship.

Asked if Ms Lamb had retrieved the documents, Mr Shorten said: "I am not aware of each piece of paper that she has".

It is understood she applied for renunciation months before voters went to the polls and it took the British Home Office 118 days to complete the process.

As a senator, Gallagher's disqualification does not trigger a byelection - she is set to be replaced on a recount by the next person on the ALP ticket, David Smith.

"To have my place in the Senate end like this today is very deeply disappointing, but I believe that I have more to contribute to public life", she said.

In the earlier stages of the citizenship crisis Shorten had been adamant that all Labor MPs had fulfilled the constitutional requirement on citizenship.
