The civil lawsuit says the producer - who denies all allegations of non-consensual sex - violated U.S. federal sex trafficking laws during the incident in Cannes, France, in 2014.
Now complaint filed in federal court on this side of the Atlantic today by actress Kadian Noble claims Weinstein sexually assaulted her at the 2014 Cannes Film Festival and TWC covered it up for another 'Friend of Harvey'.
But there he assaulted her in the bathroom, groping her and forcing her to perform a sex act on him despite her protestations and her attempt to flee, according to her lawsuit filed in NY this week.
"Kadian has suffered severe injuries and emotional distress, pain and suffering, mental anguish, inconvenience, loss of capacity for the enjoyment of life, inability to lead a normal life, shame and humiliation", lawyer Stuart Mermelstein writes.
Noble is seeking unspecified damages, accusing Weinstein of being able "to force or coerce" her into sexual activity in his hotel room by promising her a film role and to wield his influence on her behalf.
It had started with film offers and mentorship in 2014, and in February, the two met in Cannes, France, where Weinstein invited her to his room at Le Majestic Hotel to go over her reel.
Bob Weinstein is a part of this action because he is alleged to have "facilitated commercial sex acts in foreign commerce" by his brother, the complaint alleges, "to obtain the enormous publicity" when the producer promoted the company's projects around the world. He then allegedly told her his "people would be in touch". The actress thought they were going to discuss a role for her.
"Instead, he used this ploy as a fraudulent means of obtaining sexual gratification", luring her to his hotel room where he allegedly "forced her hand to masturbate him" until he "ejaculated onto the bathroom floor".
Harvey Weinstein Ousted From His Production Company
Weinstein then apparently called a TWC producer who told Noble she needed to be "a good girl and do whatever [Weinstein] wished".
The company's board has previously said it was blindsided by the sexual misconduct allegations against Harvey Weinstein.
"TWC employees knew to "take care" of the FOHs".
The complaint then lays out its reasons for naming The Weinstein Company and Bob Weinstein as co-defendants.
As for Weinstein, he is under investigation by police in New York, Los Angeles, Beverly Hills, and the United Kingdom for multiple sexual assault charges.
The company violated USA sex trafficking law by "benefiting from, and knowingly facilitating, the venture in which Harvey Weinstein traveled in foreign commerce to recruit or entice female actors into forced or coerced sexual encounters on the promise of roles", states the lawsuit.
A spokesman for the Directors Guild of America confirmed that Weinstein had resigned, several weeks after president Thomas Schlamme announced disciplinary charges against the tycoon, but refused to comment further.
