Trump mulls capping refugee quota at lowest level since 1980

The Supreme Court temporarily upholds Donald Trump's travel ban

The U.S. Supreme Court Sept. 12 temporarily blocked part of a lower court ruling that would have allowed certain refugees into the country even though they had been banned by a presidential executive order.

Kennedy ordered challengers to the administration's refugee ban to submit written arguments in support of the lower court ruling by midday Tuesday.

The Supreme Court has granted the Trump Administration's request for a stay in a federal court's decision that would have allowed some 24,000 pre-sponsored and pre-approved refugees to resettle in America. With the Supreme Court's order on Tuesday, these have prevented the above rulings from going into effect for now.

On Tuesday, White House spokeswoman Sarah Huckabee Sanders said told the Associated Press: "We are pleased that the Supreme Court has allowed key components of the order to remain in effect". Since June 26, Trump's administration got only a partial implementation from the E.O except for people who had bona fide relationships with people or organizations in the US. President Barack Obama had raised it to 110,000 from 70,000 while in office. Officials at the National Security Council, State Department, and Defense Department have opposed a significant drop in the number of refugees accepted, per the Times. Both moves were overturned in federal courts until the Supreme Court agreed in June to review the ban this October. The justices are expected to hear arguments [docket, PDF] related to the case on October 10.

On Monday, Justice Kennedy issued a stay at the request of the Department of Justice, blocking a preliminary injunction previously upheld by the U.S. Court of Appeals for the Ninth Circuit.

Justices will have to examine whether the travel ban discriminates against Muslims in violation of the U.S. Constitution, as lower courts previously ruled.

The government had repeatedly argued that merely possessing such an assurance of resettlement does not give those refugees a sufficient link to this country to enable them to enter.

A representative for the Hawaii attorney general, who challenged the administration in court, could not immediately be reached for comment. The Justice Department this week asked for an emergency ruling on the Ninth Circuit's decision, but only as it applied to refugees with formal assurances.
