Nash latest MP caught up in dual-citizenship saga

Just moments before parliament rose for a two-week break, the deputy Nationals leader told the Australian Senate she had received preliminary advice from the British Home Office on Monday that she had received dual-citizenship at birth through her Scottish-born father.

Like the dual nationality case of Barnaby Joyce, Senator Nash's case will be referred to the High Court.

Nash revealed she is a United Kingdom citizen by descent because of her Scottish-born father in a short, unheralded statement to the Senate on Thursday evening just before the adjournment.

"On the basis of the Solicitor General's advice, the Prime Minister has indicated to me he sees no reason for me to stand aside from my (portfolios)", she said.

Senator Nash is the Minister for Regional Development and Regional Communications.

Desperate to cling to office, Prime Minister Malcolm Turnbull today repeated his assertion that the High Court will declare the three ministers eligible to remain in parliament.

It comes after Mr Hipkins was accused of interfering in Australia's constitutional crisis putting two Parliamentary questions to Internal Affairs Minister Peter Dunne about the citizenship of children born in Australia to a New Zealand father.

Mr Pitt wouldn't comment on Senator Nash's situation as it would now be referred to the High Court once parliament resumed on September 4. The remainder of the politicians who may be in breach of the Constitution are from the Senate.

Deputy Prime Minister Barnaby Joyce, the Nationals leader, told Parliament on Monday that he had recently discovered he was a New Zealander through descent from his New Zealand-born father but did not concede he was ineligible to be a lawmaker.

"My father was born in Scotland in 1927".

The only politicians to resign over their citizenship eligibility are Greens senators Scott Ludlam and Larissa Waters.

Senator Nash is the sixth parliamentarian to be a dual citizen.

The meaning of section 44 (i) has not been read by the High Court as an absolute bar on a candidate being a foreign citizen.

It also does not endanger the government's majority because she sits in the Senate.

Earlier, Australian Conservatives Senator Cory Bernardi, a former Liberal, called for Parliament to be suspended until the crisis is resolved.
