Oregon Giving Residents a Third Gender Option For Driver's Licenses

Oregon becomes first state to allow nonbinary on drivers license

According to Amber Ferguson of the Washington Post, the Commission's decision "became inevitable" after an or judge allowed 52-year-old Jamie Shupe to legally identify as non-binary in June of last year.

Lambda Legal said that nationally, people have been harassed and even assaulted after presenting IDs to police, hospital workers, employers, airport staff, bank tellers and others that don't match their gender identity or expression.

"Our lives are so gendered, which is why it's important that driver licenses and other forms of IDs recognize people who are non-binary", Nancy Haque of Basic Rights Oregon said in a statement.

Gender non-binary residents will soon be able to select "X" for non-specified gender when they apply for their identification cards.

The DMV made the change after a Multnomah County judge allowed retired Army mechanic Jamie Shupe to legally identify as non-binary.

The decision came from the state's Transportation Commission Thursday evening.

The policy change was cheered by supporters as a major step in expanding legal recognition and civil rights for people who do not identify as male or female. Out reports that the change will go into effect on July 3.

Since Shupe's petition was granted, judges in two OR counties have granted similar petitions to transgender people.

Last year, intersex activist and Navy veteran Dana Zzyym sued the federal government for the right to choose a third gender on their passport. And there are quite a few of us: According to the results of a GLAAD survey released earlier this year, 12 percent of millennials identify as trans or gender non-conforming. "Removing barriers for people is critical to helping all of us live healthy, productive lives". Applicants who want a new ID will pay fees for replacement or renewal.

Oregon Department of Motor Vehicles officials say they received little opposition to the change, which they first announced plans to carry out last summer. "The state of OR sees me for who I am".

As OPB's Kristian Foden-Vencil reported a year ago, several other countries recognize a third gender, including India, Pakistan, Australia and Germany. California would be the first state to establish a third gender option through legislation.

The license decision comes a year after a judge in OR ruled, in what legal experts believe is the first such decision in the US, that a transgender person can legally change their sex to nonbinary, allowing a change from female to nonbinary by 52-year-old Jamie Shupe.
