Seconds podcast: The jury deliberates

The Minnesota police officer charged with fatally shooting a black motorist during a traffic stop a year ago, the aftermath of which was streamed on social media by the driver's girlfriend, was not justified in firing his gun, prosecutors said on Monday.

In July 2016, police officer Jeronimo Yanez shot Philando Castile during a traffic stop.

Seventy-four seconds is the amount of time that elapsed between the moment Yanez turned on his squad vehicle lights to the moment he fired the seventh and final shot into Castile's auto.

In that Facebook video, Castile - bleeding heavily - insists that he hadn't been reaching for his gun, which he had a permit to carry.

Finally, Leary instructed the jury to return with a unanimous verdict, arrived upon after using "sincere judgement, sound discretion, and in accordance with the facts as you find them from the evidence and the law I have just given to you", Leary's instructions read.

Gray agreed that the officer did not say the gun was black in his initial statements, but Gray made clear that the reason was because Yanez "had just been traumatized".

The mother of a black man fatally shot by a Minnesota police officer last July says her son shouldn't have died the way he did.

After he shot Castile, Yanez is heard on the squad auto video telling a supervisor variously that he didn't know where Castile's gun was, then that he told Castile to get his hand off it.

"I told him, 'Don't pull it out, ' " Yanez testified in court, adding that he tried to distract Philando, but "he continued to pull his firearm out of his pocket". He also cited testimony from first responders who saw Castile's gun in his pocket as he was loaded onto a backboard.

Yanez was emotional throughout his testimony, claiming that fear overtook him during his exchange with Castile.

Leary III defined culpable negligence in his jury instructions as "intentional conduct that the defendant may not have meant to be harmful, but that an ordinary and reasonable prudent person would recognize as involving a strong probability of injury to others", adding the concept includes gross negligence coupled with an element recklessness.

Reynolds then live streamed the aftermath.

"The victim in this case was a good man too", Paulsen said, and referred to Castile's job at an elementary school.

Yanez never said he was sure he saw a gun, until he testified, Paulsen said. "And now they've been deprived of that role model". The two sides called competing experts earlier who disagreed over whether Castile was intoxicated.

Leary's instructions included the legal definition of second-degree manslaughter in Minnesota, as well as the elements the jury must consider related to the charge.

After three white alternates were dismissed following closing arguments, the 12-member jury includes two blacks.

Toward the conclusion of his closing argument, Gray told jurors that if they take in all the facts of the case they'll see that the state "failed miserably". "How in the world can the State of Minnesota, the prosecution, be so unfair about that statement?"
