Salient features of ICJ's ruling on Kulbhushan Jadhav case

The International Court of Justice today gave out its verdict on India's plea on Kulbhushan Jadhav death sentence case in Pakistan, saying the Indian should have been given consular access.

Applauding the International Court of Justice (ICJ) for putting a temporary stay on Kulbhushan Jadhav's execution, the Congress on Thursday asked Pakistan to comply with the order till the final verdict is delivered.

The court told Pakistan to take all possible measures to ensure that Jadhav is not executed before the worldwide court gives its final verdict. Pakistan's attorney general said that the recent order by ICJ does not change anything in Kulbhushan Jadhav's case.

He lauded the ICJ's unanimous decision granting a stay on the execution of Jadhav, who was sentenced to death in Pakistan on espionage charges.

The judges said India had a "plausible" argument that Pakistan violated global law by refusing to grant consular access to Jadhav. The UN's top judicial body said Jadhav, a former Indian naval officer, should be given consular access. The judge also stated that the severity of a death sentence provided necessary urgency for the court to implement provisional measures.

He said Pakistan has already informed the ICJ that it does not accept its jurisdiction in matters related to the national security.

The ICJ, also known as the World Court, was set up in 1945 to rule on disputes between states in accordance with global law.

Jadhav was caught by Pakistan in March 2016 and charged with espionage - an accusation New Delhi denies. India took Pakistan to the United Nations.

The worldwide court of justice, sometimes referred to as the world court, is the UN's court for hearing disputes between states.

Hailing the order as "major victory" for India, Union Minister M Venkaiah Naidu said it has "exposed" Pakistan and exuded confidence that the final order too will be go in Indias favour.

No date has yet been set for Mr Jadhav's execution, although Pakistan told the ICJ during the trial that it was unlikely to happen before August 2017. The tribunal has not yet decided whether it has jurisdiction to hear India's case, and a final ruling could take months, if not years.
